Terms and Conditions
SALES
1. Customers should check their order details are correct, in particular with respect to model, colour, size and type and satisfy themselves that the goods they have chosen are designed for their particular use and requirement. The Customer is also responsible for checking (prior to purchase and delivery) the dimensions of any goods purchased to ensure that they can be accommodated into their property (in particular, checking the width of doorways and stairways). No refund will be given if the goods ordered cannot be so accommodated.
2. The Company accepts payment by cheque or by any of the following credit/debit cards: Visa, Mastercard, Switch and Solo. However please note that, if paying by cheque, payment in full must be made at least one week prior to delivery.
3. Subject to clause 2 above, a deposit of 10% of the full amount owing to the Company upon sale (including applicable delivery charges) for any goods is to be made at the time of sale and the balance must be made in full prior to delivery. All overdue accounts will be charged at the rate of 2% per month for as long as the account remains unpaid, furthermore all special discounts will be terminated and discounts that may have been allowed on outstanding invoices will be cancelled and re- invoiced. The above-mentioned 2% will be charged in accordance with s.69 County Court Act 1984. Additional interest at a maximum of 5% above Barclays Bank base rate will be applied to the account in direct relation to the cost of financing the outstanding account throughout the overdue period.
4. In the unlikely event of you failing to pay your account by the due date, you hereby agree to pay all costs in relation to the collection of the debt including tracing fees, debt collection, interest at 2% per month and all legal fees. Any outstanding or overdue accounts will be passed to our Debt Collection Agency.
5. All prices are inclusive of VAT.
6. All size and weight specifications are approximate.
7. All orders are accepted subject to availability.
8. For as long as any monies are outstanding to the Company in respect of any goods sold subject to these conditions, the seller will retain legal, equitable and beneficial ownership of all such goods until all the indebtedness has been discharged by the purchaser.
REFUNDS AND RETURNS
9. Claims for damaged goods, short delivery or incorrect goods must be made within 7 days of receipt of goods. Claims made after this period will not be entertained. Any complaint of any nature relating to goods supplied must be reported within 14 days supported with proof of purchase. We carry a 12 month warranty with all of our goods (excluding those marked as seconds), which have either a manufacturing or material defect.
10. If the Customer is not satisfied with any goods purchased from the Company a full refund is available (minus delivery expenses). In order to claim such refund you must contact us with 7 days of the original delivery to arrange for the return of the goods with proof of purchase and such goods must be in a fully saleable condition. Where possible, please keep/place the goods back in their original packaging. The refunded goods shall be collected from the delivery address as soon as practicable upon the refund being demanded and the applicable delivery charge shall apply (see clause 12 below). If delivery of the goods has been arranged the order must be cancelled at least 24hrs prior to the day of delivery otherwise a 15% admin fee will apply. Refunds will be issued to the credit card that was used to place the order and shall be issued at the time when the goods are received by the Company at the point of sale.
DATA PROTECTION
11. We are committed to protecting your online privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). The purpose of this statement is to set out how we use personal information that we may obtain about you. By using the Farrow Furniture Ltd web site generally you agree to this use. We collect information about you to process your enquiry and to provide you with the best possible service. You may be asked to voluntarily provide information about yourself at the time of purchasing a product (e.g. delivery and invoice address information). We only pass information to fulfilment partners (e.g. our suppliers and delivery contractors) when it is necessary to conduct the transaction.
DELIVERY
12. Delivery is a sever able part of the order / contract. It is offered at the discretion of the Company as an additional and optional charge and service to Customers. Prices are available on request and vary according to the number and size of items as well as the proposed delivery address. Free delivery is not available on any refunded goods returned in accordance with clause 10 above.
13. All delivery times and dates (where offered) are given in good faith but should goods be delayed due to circumstances beyond our control we will not be held responsible.
14. Where goods are requested to be delivered, such delivery is limited to the customer’s previously notified address and only as far as the front door of that address. At the customer’s request and at the discretion of the delivery driver the goods may be taken into the customer’s property, but we accept no liability for loss or damage which may arise to either the goods or the customer’s property as a consequence of such further arrangements.
MISCELLANEOUS
15. The conditions here listed together with any and all other conditions as set by the Company cannot be varied, suspended or added to except with the written agreement of the Company.
16. The construction, validity and performance of any contract shall be governed by and construed in accordance with English Law.
